Terms of Service

By using the SSHControl.com web site (“Service”), or any services of SSH Control LLC (“SSH Control”), you (“Customer”) are agreeing to be bound by the following terms and conditions (“Terms of Service”).

SSH Control reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time.

Violation of any of the terms below may result in the termination of your Account. While SSH Control prohibits such conduct or Content on the Service, you understand and agree that SSH Control cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk and SSH Control assumes no liability.

Typical Service

SSH Control seeks to provide SSH-available repository hosting and backup service to Europe and Amazon S3 at a fixed monthly fee.

Customer Rights and Responsibilities

SSH Control will not resell customer data to third parties.
SSH Control respects customer privacy.
SSH Control tries to provide a secure Service, but relies on the customer to also maintain security procedures adequate to their needs.
Customer is responsible for maintaining the security of the account and password. SSH Control cannot and will not be liable for any loss or damage from failure to comply with this security obligation.

General Conditions

Your use of the Service is at your own risk. The service is provided on an “as is” and “as available” basis.
You understand that SSH Control uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
Technical support is only provided to paid account holders and is only available via email.
You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, SSH Control, or any other SSH Control service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by SSH Control.
SSH Control may, but has no obligation, to remove Content and Accounts containing Content that SSH Control determines in its sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any SSH Control customer, employee, member, or officer will result in immediate account termination.
You must not upload, post, host, or transmit unsolicited email, SMSs, or “spam” messages.
You must not transmit any worms or viruses or any code of a destructive nature.
If Customer bandwidth usage is excessive (as determined solely by SSH Control) we reserve the right to restrict write or read access for the account or until the Customer can reduce your bandwidth consumption.
SSH Control does not warrant that (i) the service will be uninterrupted, timely, secure, or error-free, (ii) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet Customer expectations, (iii) any errors in the Service will be corrected, (iv) the results that may be obtained from the use of the service will be accurate or reliable. SSH Control does not warrant that the service will meet any specific Customer requirements.
The failure of SSH Control to exercise or enforce any provision or right of the Terms of Service shall not constitute a waiver of such provision or right. The Terms of Service constitutes the entire agreement between you and SSH Control and govern Customer use of the Service, superceding any prior agreements between you and SSH Control (including, but not limited to, any prior versions of the Terms of Service).

Website Login and Billing Account Terms

You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
You must provide a valid email address, and any other information requested in order to complete the signup process.
You must be 13 years or older to use this Service.
Your login may only be used by one person – a single login shared by multiple people is not permitted. You may create as many billing accounts under each login as you like.
The Customer is responsible for all Content posted and activity that occurs under the Customer's account.
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). Illegal or unauthorized use of the Service is expressly prohibited.
One person or legal entity may not maintain more than one login on the website. Each login is entitled to one free account.

HTTP access and REST or other API Terms

Customers may access their SSH Control account data via an API (Application Program Interface). Any use of an API, including use of an API through a third-party product that accesses SSH Control, is bound by the terms of this agreement plus the following specific terms:

You expressly understand and agree that SSH Control shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if SSH Control has been advised of the possibility of such damages), resulting from your use of the API or third-party products that access data via the API.
SSH Control reserves the right at any time to modify or discontinue, temporarily or permanently, your access to the API (or any part thereof) with or without notice.
Abuse or excessively frequent requests to SSH Control via HTTP or the API may result in the temporary or permanent suspension of your account's access. SSH Control, in its sole discretion, will determine abuse or excessive usage of the API. SSH Control will make a reasonable attempt via email to warn the account owner prior to suspension.

Payment, Refunds, Upgrading and Downgrading Terms

All paid plans must have a valid paid subscription. Free accounts are not required to provide a paid subscription.
An upgrade from the free plan to a paid plan will immediately bill you.
For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged the new rate on your next billing cycle.
The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.
All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.
Downgrading your Service may cause the loss of Content, features, or capacity of your Account. SSH Control does not accept any liability for such loss.

Cancellation and Termination

You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation. You can cancel your account at any time by ending your subscription through means documented on the SSH Control website or directly cancel your subscription via the payment provider, currently PayPal through the subscription control panel.
Generally, all of your Content is deleted from the Service 60 days after the last payment has been received. This information can not be recovered once your account is cancelled. This procedure may be adjusted in specific circumstances. Even though data is kept for 60 days, accounts may be set read-only immediately upon account cancellation or in the case of an overquota event. This setting still allows Customers to copy their data off the server before the data and account are finally terminated.
If you cancel the Service before the end of your current paid up month, your cancellation will immediately take effect and you will not be recharged.
SSH Control, in its sole discretion, has the right to terminate or suspend your account and refuse any and all current or future use of the Service, or any other SSH Control service, for any reason at any time, or for no reason at-will. SSH Control reserves the right to refuse service to anyone for any reason, or no reason, at any time.

Modifications to the Service and Prices

SSH Control reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) without or with notice.
Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice by SSH Control. Such notice may be provided at any time by posting the changes to the SSH Control Site (SSHControl.com) or the Service itself.
SSH Control shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Copyright and Intellectual Property

SSH Control claims no intellectual property rights over the material you provide to the Service. Your uploaded materials remain yours.
SSH Control does not pre-screen Content, but SSH Control and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.
